The Grower Ltd have been growing and selling quality trees and hedging since 2021 and strive to supply trees, hedging, sundries and services of the highest quality to all our customers. Our mission ensures complete end to end traceability of planting material supplied, to connect you with the people growing your trees. We believe it is important for you to know what information we collect and how we treat the information you share with us.

For example, when you request a quote, make a purchase with us or book on to any of our tours and visits to the farm, we will ask you for your personal information in order to for us to process your quotes, purchase orders, and book you on to an event, to be able to deliver an item, or send your invoice. Some online identifiers (such as static IP addresses) are personal information.

We collect Device Information to ensure adequate technical support for our website and ensure it is functioning properly on all operating systems/browsers. This is to ensure the content of our website is being presented to you in the most appropriate way to ensure it is easy to use/navigate. We use this information in order to allow you to participate in interactive features on the website where you choose to do so.

We collect Log Information to improve our websites functionality and our customer service by better understanding how our website is used.

Your Device Information and Log Information will be combined with that of our other users and reported in statistical form. It is not possible to identify you from this combined information.

If you book onto a tour or visit with The Grower Ltd., we may collect the following data: Company/Organisation name, personal name, email address, phone number, and dietary requirements (if applicable).

We will use this data for the following reasons:

  • To confirm your booking, either by email or by phone

  • To update you with any information about the event that you have booked

  • To ask for your feedback, post event

We process this data in order to perform our contract with you or as part of our legitimate business interests.

3.3 Deliveries

If you arrange a delivery for products from The Grower Ltd., we will collect the following personal data: name, phone number, email address delivery address, delivery postcode

We will use this data for the following reasons:

  • To arrange delivery of purchased goods

  • To pass delivery details to the specified supplier to arrange delivery

  • The supplier will share delivery details with their specified couriers to ensure delivery

We process this data in order to perform our contract with you.

When you send us an enquiry or complaint we will share this information and details with relevant parties to be able to resolve your enquiry.

Limited to:  photography, accident forms, and CCTV imagery for the purposes of crime prevention and public safety / videos and phone call logging to ensure that we continually improve our services and allow us to deal with complaints.

Images and photography


When you are visiting our nursery or attending an event your photograph may be taken if you have given your consent. If you consent to having your photo taken and used for marketing or PR purposes we will hold your name and image on file for future re-use. We will ask you to fill out a Consent and Release Form to allow us to use your image for such purposes.

 

Email/text/telephone marketing

If you are a sole trader, we will only contact you by email if you have consented to this (unless there is a legitimate reason to contact you). Consenting to The Grower Ltd. emails or opting into email communications, means you have granted us permission to use your email address to send you email marketing communication. You may choose to opt out of such communications at any time – more information about opting out is in section 3.8.

3.6 Direct marketing

If you have provided us with your postal address, we may contact you by post if you have consented for us to do so. We may also contact you by post if we have a legitimate reason to contact you.  Consenting to The Grower Ltd. postal marketing means you have granted us permission to use your address to send you marketing communications.

The Grower Ltd. will not sell your data and we will not share your data for third party marketing purposes. In some circumstances we may need to share your details with a third party for order processing and delivery of goods.

If we would like to use any information that you have provided to us for marketing purposes, we will always ask for your consent to do so.  For example, if we display testimonials of satisfied customers on our website or advertising materials. With your consent, we may post your first name alongside the quote.

If you are a sole trader, you always have a choice as to whether you want to receive communications about our products and services, and how you receive them. You can opt out of this when we collect your details or later. 

If you want to change your preferences, or opt out of communications, you can do so by contacting contact@thegrower.co.uk at any time. You can also opt out of the email marketing by clicking the unsubscribe link at the bottom of any email from us.

If you choose not to be contacted by us we will never send you personalised marketing communications.  We will only keep any necessary details on a ‘list’ to ensure you aren’t contacted.

3.9 Lawful basis for processing your personal data

In some situations we will collect and process your personal data using the legitimate interest legal processing basis. 

This means we’ll process your data as it is part of a contract which you have entered into. For example:

  • Quotes and orders – to provided pricing information and goods to fulfil our contract.

  • Events – if you have booked an event with us, then we will need to contact you to ensure we can provide the relevant services under the booking agreement with you.

In most circumstances however, we will rely on your consent when we use your personal data. An example of this would be when we request your consent to receive marketing emails from The Grower Ltd..

3.11 Under 16s

​

On any rare occasion that we may have to collect and manage data of under 16’s, for example school visits where photos are taken, or work experience. We will always require a consent form to be completed. We will always manage this data in a way which is appropriate to the age of the child and will only keep this data for the purpose in which it was collected. We will always seek consent from parents or guardians of the child.

3.12 Job application data

​

All vacancies at The Grower Ltd. are advertised on our website though we do not collect or store any of your details on our website.  When you click on the link you are being transferred to our third party supplier.  Please refer to their privacy policy on their pages for further details of data protection and how your personal details are processed.

Once the recruitment and selection process has commenced and a recruitment decision has been made personal information will be retained for a period of 6 months from the date that the outcome was communicated to the applicant.

Information relating to successful candidates will be transferred to their employment record.  This will be limited to that information necessary for the working relationship and where applicable that required by law.

It is in our legitimate business interests to collect this information.

4. How do we keep your personal data secure?

To protect the personal data you provide us with we always ensure that we have the necessary controls in place, implementing suitable physical or electronic security alongside organisational training. Regular audits are carried out to identify who has access to data so that we can ensure that your information is only accessed by trained staff who have a legitimate reason to access it.

The data that we collect from you may be transferred to, and stored at, a destination outside the European Economic Area (EEA). It may also be processed by staff operating outside the EEA who work for us or for one of our suppliers. Such staff maybe engaged in, among other things, the provision of support services. When we use external companies to process your personal data on behalf of The Grower Ltd. thorough checks are carried out on any companies we work with. Contracts are in place with each of these companies to ensure that they process your information in line with our expectations and the General Data Protection Regulation.

Although we will do our best to protect your personal data, we cannot guarantee the security of your data transmitted to our channels; any transmission is at your own risk. Once we have received your information, we will use strict procedures and security features to try to prevent unauthorised access.

Sometimes we use external companies to process your personal data on behalf of The Grower Ltd.. We carry out thorough checks on any companies we work with and have a contract in place with each of these companies to ensure that they process your information in line with our expectations and the General Data Protection Regulation.

We also ensure our systems and processes comply with PCI DSS, the worldwide Payment Card Industry Data Security Standard. This is achieved through tight controls of storage, transmission and processing of data, it is intended to safeguard sensitive cardholder data.

  • request that we transfer your personal information to another provider (this is known as data portability);

We will use information in accordance with the privacy policy under which the information was collected.
